[0:00 - 0:14] What up y'all, so I was just made aware that somebody made a Wix site which ironically
[0:14 - 0:24] got shut down. The guy's name is Spawn of Ruple. Now Spawn of Ruple apparently took
[0:24 - 0:39] some of my artwork that I created in the fair use shit and redid it. What's on discord bro,
[0:39 - 0:51] hold up. But this dude Spawn of Ruple wanted to take some of my artwork and you know redo
[0:51 - 0:57] it just like I've done. And hey, honestly, I'm not even mad. If you want to take and
[0:57 - 1:04] redo my artwork that I've already done the fair use shit with, if you want to take and
[1:04 - 1:12] redo it, hey, I welcome that. I love to see the creativeness like if I inspire you that
[1:12 - 1:27] much that you want to take a piece that I totally redid and you know go in and redo
[1:27 - 1:34] it in your own style and you know make a profit out of it, hey, go ahead. I enjoy that.
[1:34 - 1:38] I want to see this shit. I personally would love to see this shit. I can inspire somebody
[1:38 - 1:45] to take a piece that I've redid in a dark artistic style and they can completely revamp
[1:45 - 1:56] it. I want to see it. I personally want to see that shit. Like I would love to see that.
[1:56 - 2:04] Like if you have redone it and you actually do have a Wix website, I want to see it.
[2:04 - 2:11] I want to see this dope ass art because I'm all about creating. Like if you take something
[2:11 - 2:17] that I've done already and you revamp it in a whole other way, I want to see it. I
[2:17 - 2:25] want to see what I inspire you guys to do. I want to see how far you guys take the fair
[2:25 - 2:31] use shit like I do. I want to see how far y'all push it. I want to see you push it
[2:31 - 2:40] to push that creativeness to the next level. So really you're not bothering me. Hey, if
[2:40 - 2:45] you come up with your own style, that's lit. If you come up with your own version of what
[2:45 - 2:52] I did, hey, that's cool. I'm not hating. That's dope that you can revamp and you push
[2:52 - 2:58] it even further and you push that boundary and that envelope even further within the
[2:58 - 3:07] fair use community. By all means, let's see what you got. I personally would love to see
[3:07 - 3:17] it. I really would. I would personally love to see what you do. Like I said, I'm a creative
[3:17 - 3:24] person, whether I'm working on artwork, whether I'm working on a revamp of a song or whatever.
[3:24 - 3:37] I love creating shit. That's how I am. If I'm not creating something, then I get bored
[3:37 - 3:42] very fast. Like I said this morning, if I'm not creating something, I'm constantly bored
[3:42 - 3:52] about not actually doing something. If you really have taken some of my artwork and
[3:52 - 4:00] you revamped it by all means, I want to see it. I want to see how cool that shit looks.
[4:00 - 4:08] So spawn of Rupal, if you can, I will put, I will give you my fucking matter of fact.
[4:08 - 4:15] There's my disc matter, but I'll post my, I will pin my discord up in the comments.
[4:15 - 4:29] So if you send me the site, I want to check this. All right. If you read, go ahead. Like
[4:29 - 4:37] if you revamped my piece that I did, like you take a piece that I completely read it.
[4:37 - 4:43] Right? Like let's say you take, like take the piece that I did this morning on live,
[4:43 - 4:51] take that piece. Okay. Take that piece that I redid and I repurposed as I showed. If
[4:51 - 5:01] you take that piece that I did and take what I did to it and revamp it into early and
[5:01 - 5:05] do a whole different spin on it, then yeah, by all means you're more than allowed to
[5:05 - 5:11] sell it. But if it's still in the original form that I left it in, then yeah, we're
[5:11 - 5:19] going to have fucking issues. Well, like I said, this, this does, doesn't apply to
[5:19 - 5:26] that Rupal guy. This applies to anyone. And I'm saying this because this, you know, not
[5:26 - 5:52] only benefits me, this benefits you guys as creators and gets you guys creating as well.
[5:52 - 5:59] You know, like I said, if you take a piece that I completely redid and you put a whole
[5:59 - 6:05] other spin on it, by all means, that's fucking dope. Cause who knows? Maybe you guys come
[6:05 - 6:16] up with something that I didn't think of that. Yeah, dude. Then we're going to have
[6:16 - 6:25] fucking problems. And if I catch you selling it, I will sue you. Plain and simple. I will
[6:25 - 6:30] sue you if you sell it. If you make any kind of profit off that work, I will sue you unless
[6:30 - 6:36] you make a major changes to it the way that I do. Like if you take and you make those
[6:36 - 6:44] changes to make it 110% different from what I did. Like if you do not make those changes,
[6:44 - 6:53] then I will sue the living fuck out of you. Now, if you do actually make changes to it
[6:53 - 6:58] and you completely redo it in your own vibe and your own style and your own take on it,
[6:58 - 7:12] then yo, that's cool. But unless there's no way that you can make a profit because
[7:12 - 7:19] people already know who I am, they know my art. And believe me, when I say I have 200
[7:19 - 7:27] plus fucking people on Facebook that will come out of your asses. And this isn't just
[7:27 - 7:30] a warning to you, man. This is a warning to anyone out there that thinks they're going
[7:30 - 7:36] to get away with stealing my fucking artwork. If anyone out there thinks that they're
[7:36 - 7:41] just going to upright and steal my artwork and not do anything to it to make it different
[7:41 - 7:49] entirely, completely revamp and redo and everything like that. If you're doing it in a totally
[7:49 - 7:57] different art style than what I do, if you do not redo the artwork in a totally different
[7:57 - 8:05] style than what I do, because people recognize my style. They know who I am. They recognize
[8:05 - 8:15] my style. So like I said, dude, unless you completely redo it, then yeah, I can and will
[8:15 - 8:25] sue you for everything that you make money with. And that's just a fair warning. That
[8:25 - 8:33] is a fair fucking warning to you that if you do not, and it's a fair warning for anyone,
[8:33 - 8:39] if you take an art piece of mine and you do not revamp it to where I cannot recognize
[8:39 - 8:48] it, like if I can't recognize what it is, then yeah, you can make money out of it.
[8:48 - 9:06] If you do not change the entire aesthetic and change the thing in its entirety, then
[9:06 - 9:21] I will sue you and I have every right to. So come at me again with that shit. Come at
[9:21 - 9:25] me again with that shit, because once I find your site, dude, I will be reporting it and
[9:25 - 9:38] having it taken down. Here's the thing, dude, there's no way to do it. There's no humanly
[9:38 - 9:54] way possible, bruh. To take some of somehow ungodly way, get it back to its original form
[9:54 - 10:04] than what I did it to. But when we made that piece, so at that point, either way, you're
[10:04 - 10:12] fucked. Either way, you are fucked. Because at that point, all I've got to do is go to
[10:12 - 10:16] that person and be like, yo, this dude is flat out stealing your shit. You need to
[10:16 - 10:24] get this guy. So, but if you take it back to the original style, bro, like you're just
[10:24 - 10:30] flat out stealing at that point, and then you have to deal with the person that creates
[10:30 - 10:39] and this and that and the other. So yeah, you may as well just quit, bro. You may as
[10:39 - 10:44] well just give the fuck up because at that point, all I got to do is reach out to the
[10:44 - 10:50] person that made the original piece, show them what I did to it and explain to them
[10:50 - 10:55] that what I did is consider how you plan on making money off of it. Then from there,
[10:55 - 11:04] all they got to do is get ahold of you. And guess what, bro, I think I didn't come prepared.
[11:04 - 11:12] You didn't think I would come prepared. Like, dude, what I do isn't theft. What I do is
[11:12 - 11:19] called fair use artwork. I take an original piece, I transform it and create something
[11:19 - 11:27] with it. I don't blame you like, Oh, this is mine now. I'm gonna take it. No, I take
[11:27 - 11:33] and I transform it and I do something with it. And guess what? Every piece that I've
[11:33 - 11:38] ever done, the original people know I do this shit. The original fucking people have
[11:38 - 11:45] seen what I do. And guess how do half the people that I've created this artwork from
[11:45 - 11:50] the phone are on the group that I've been on Facebook and guess what? They fucking love
[11:50 - 11:59] what I do. They see what I do and they fucking love it. Matter of fact, the person that originally
[11:59 - 12:05] created that one post that I posted up the one day in my Discord, that I were 200 people
[12:05 - 12:13] like, guess what? The original owner of the original piece that it stemmed from commented
[12:13 - 12:24] on it and actually loved it. They enjoy it. So do not think that I didn't come prepared
[12:24 - 12:35] because I did. I think that you're gonna get away with still in my artwork or try keyword
[12:35 - 12:43] try to transform it back to its original state. Bro, don't even fucking bother. Don't even
[12:43 - 12:47] fucking bother because at that point, all I got to do is hit up the original person
[12:47 - 12:53] and be like, yo, this dude is over here trying to jack your fucking artwork. They're not
[12:53 - 13:03] being transformative with it. And they're trying to make money off of it. So bro, just
[13:03 - 13:08] quit, dude. Give it the fuck up. You're not going to get nowhere. You're just digging
[13:08 - 13:20] yourself a deeper hole. And here's the thing, what I do, do I really need to play that
[13:20 - 13:26] video back? Do I really need to play that video back again for this morning? You know
[13:26 - 13:54] what? Let me play that video back. Let me play this video back for you guys so you
[13:54 - 14:01] can be better informed on what I do. So what are you doing with, you know, the copyrighted
[14:01 - 14:07] content that you want to use? And are you creating new value, adding something new,
[14:07 - 14:16] different? This has been the heart of the fair use case law over the last I'd say really,
[14:16 - 14:24] at that point, you're just committing theft at that point. And I could sue you for copyright.
[14:24 - 14:29] I didn't shit it. You're doing something with a totally different purpose. But new tool
[14:29 - 14:35] or as meaning, you're going to be, you know, that's what we call transformative. Do you
[14:35 - 14:41] have a transformative purpose? Can you articulate it? And is it something within your work
[14:41 - 14:44] that when other people watch it, they're like, Oh, yeah, I get it. I get what you're
[14:44 - 14:51] doing is different than new and etc. Okay, so today, much anticipated examples. This
[14:51 - 14:57] was a case called Blanche versus Coons. Andrea Blanche is a photographer. She took this
[14:57 - 15:06] photo of this pair of legs over here for an ad that appeared in a war magazine. Jeff
[15:06 - 15:12] Coons is a very famous artist. He's also famous in the very use world. He's been sued, I
[15:12 - 15:18] think this might have been the third time he was sued for copyright infringement and
[15:18 - 15:26] the first time he won. So he used a fragment of the Allure photograph, there in the black
[15:26 - 15:32] and white, and you can see where the feet, the second from the left, have been inverted,
[15:32 - 15:36] but you know, he took the original photographs and then that, you know, do what he did.
[15:36 - 15:45] But there, the court held that this was a fair use because comment upon the culture
[15:45 - 15:54] and attitudes promoted and embodied in the Allure magazine. And this was while he wasn't
[15:54 - 16:01] commenting on Andrea Blanche's epiquity of this kind of imagery and using that as an
[16:01 - 16:08] example of that imagery. And the court said that using that original photo as father
[16:08 - 16:16] or his commentary, a bigger picture commentary on society was a fair use. Here's another
[16:16 - 16:18] fun one.
